Yes. Medicinal cannabis is legal in Australia when prescribed by a doctor under the Therapeutic Goods Administration’s (TGA) Special Access or Authorised Prescriber schemes. All prescriptions must comply with federal and state/territory regulations.

Q6. Can I drive if I am prescribed medicinal cannabis?

Laws vary by state. In Victoria, for example, driving with any amount of THC in your system is still (technically) an offence, even if the THC comes from a prescribed medicinal cannabis product. However, as of 1 March 2025, magistrates have the discretion to decide whether to cancel a driver’s licence for THC presence if you:

  • hold a valid prescription for medicinal cannabis at the time, and

  • were not impaired while driving.

If you’re prescribed a medicinal cannabis product, always check the THC content with your doctor or pharmacist, carry your prescription, and avoid driving if you feel impaired.
